Terms of Service

1. Acceptance of Terms

By accessing or using Mosha ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and Mosha. We reserve the right to update these Terms at any time; continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

2. Description of Service

Mosha is a web-based AI-assisted motion graphics platform. You describe a video or animation in natural language; our system generates a structured scene graph that is rendered in real-time in your browser via Remotion. You may export the result as an MP4 file subject to your subscription tier. The Service is provided "as is" and is subject to change, suspension, or discontinuation at any time.

3. Account Registration

You must sign in with a valid Google account to access the Service beyond the free trial. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must provide accurate information and promptly update it if it changes. We reserve the right to suspend or terminate your account if we reasonably believe it has been used fraudulently, abusively, or in violation of these Terms.

4. Subscriptions, Payments, and Refunds

Mosha offers paid subscription tiers ("Starter", "Pro", "Business") and one-time point top-up purchases, billed through Stripe. All prices are in USD and exclusive of applicable taxes unless stated otherwise.

  • Auto-renewal. Subscriptions renew automatically at the end of each billing period. You may cancel at any time in your billing settings; cancellation takes effect at the end of the current period.
  • No refunds. All payments are non-refundable except where required by applicable law. We do not pro-rate cancellations. If you believe you were charged in error, contact us within 14 days of the charge.
  • Price changes.We may change subscription prices with 30 days' notice. Continued use after the effective date constitutes acceptance of the new price.
  • Failed payments. If a payment fails, we may downgrade your account to the free tier and forfeit any unused points or benefits accrued under that subscription.

5. Points System

Points are a virtual in-service credit used to run AI generation and export requests. They have no monetary value, are non-transferable, and cannot be redeemed for cash.

  • Free-tier users receive a one-time allocation of 100 trial points on sign-up.
  • Subscription points are granted at the start of each billing period and expire if unused at renewal.
  • Top-up points do not expire but are also non-refundable.
  • We reserve the right to adjust point costs for operations, revoke points obtained fraudulently, and modify the points system with reasonable notice.

6. AI-Generated Content

The Service uses AI models to interpret your prompts and generate motion graphic scene descriptions. You acknowledge that:

  • AI outputs are probabilistic and may be inaccurate, incomplete, or unexpected.
  • We make no warranty that AI-generated content is suitable for any particular purpose, free of errors, or commercially viable.
  • You are solely responsible for reviewing, editing, and ensuring the appropriateness of any content you create and export through the Service.
  • You retain ownership of the original prompts you submit. Subject to these Terms, you own the exported video files you produce, provided they do not infringe third-party rights.
  • We retain a non-exclusive, royalty-free licence to store, process, and cache your scene data for the purpose of delivering the Service.

7. Acceptable Use

You agree not to use the Service to:

  • Generate content that is illegal, defamatory, obscene, or harassing;
  • Infringe any intellectual property rights of third parties;
  • Attempt to reverse-engineer, scrape, or abuse the API or AI models beyond what is explicitly permitted;
  • Circumvent rate limits, point systems, or subscription restrictions;
  • Distribute malware or conduct phishing or other fraudulent activities;
  • Use the Service in any manner that violates applicable laws or regulations, including export control or sanctions laws.

We reserve the right to suspend or permanently ban accounts that violate these rules without refund.

8. Exported Files and Storage

Exported MP4 files are stored temporarily on Cloudflare R2 with a 3-hour signed download link. After that window, the file is deleted. We are under no obligation to retain exported files beyond this window. You are solely responsible for downloading and storing your exports before they expire.

9. Intellectual Property

The Mosha platform, its design, code, component library, branding, and documentation are owned by us and protected by applicable intellectual property laws. Nothing in these Terms grants you a licence to our intellectual property beyond the right to use the Service as described herein.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

We are not responsible for any loss of data, including exported files that expire before download.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MOSHA, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $50.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access immediately and without liability if you breach these Terms or if we decide to discontinue the Service. Upon termination, your right to use the Service ceases immediately and any unused points are forfeited.

13. Governing Law and Disputes

These Terms are governed by and construed in accordance with applicable law. Any dispute arising out of or relating to these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration or a court of competent jurisdiction in the jurisdiction where we operate.
